Terms and Conditions
1. Area of application and subject matter of the agreement
1.1
Developermail is an email service of the mindthedev UG (haftungsbeschränkt), Herzogstraße 25, 63263 Neu-Isenburg, hereafter referred to as minthedev. The following terms and conditions apply and are part of contracts concluded to use Developermail.
1.2
Subject of use is the creation of an account and its administration by the customer, as well as all services offered by Developermail.
2. Conclusion of contract
The contracts is concluded by the registration on https://developermail.io/signup, by filling in and submitting the sign-up form.
3. Services
mindthedev offers the following services to Developermail customers:
After registering using the "username@developermail.io" format:
- Configuration via the Developermail Git configuration
- An email account for "username@developermail.io" including 5GB storage
- Three additional aliases in the format "aliasname@developermail.io"
- Unlimited amount of calendars
- Unlimited amount of address-books
- The possibility of creating a forward
- Unlimited additional aliases in the format "aliasname@example.com"
- Unlimited amount of forwards
- Unlimited amount of calendars
- Unlimited amount of address-books
- Sending and receiving emails
- A spam-filter (Very obvious spam-mails will be rejected by our systems using the "reject" method)
Developermail services are available to the customer 99% per year. However, mindthedev cannot guarantee a 100% availability of the aforementioned services. For more information, see item 8. Maintenance periods resulting in down-time will be announced in advance.
4. Customer obligations
4.1
Customers keep the password of their account secret. The customer will immediately change, or let mindthedev change it, if an unauthorised third party may have discovered it.
4.2
Customers are also responsible for third parties who use the services within their account (whether authorised or unauthorised). This does not apply when the unauthorised access had nothing to do with the customer. The obligation is on the customers to prove they had nothing to do with the usage.
5. Missuse
5.1
The customer is required not to use Developermail improperly. This includes not sending more than 1000 emails a day, as well as not violating any German laws.
5.2
Customers are liable to mindthedev for damages resulting from a breach of their responsibilities under 5.1 and absolve mindthedev from claims of any third parties in this regard. This does not apply when the unauthorised access had nothing to do with the customer. The obligation is on the customers to prove they had nothing to do with the usage.
5.3
If the customer uses mindthedev against the conditions set out in 5.1, the account can be blocked by mindthedev without notice. The right to immediate termination remains.
6. Virus scanner
Aside from the heuristic spam-filter, Developermail doesn't use an additional, signature-based virus scanner.7. Deletion of accounts
A customer can request the deletion of all associated data on our services after the termination of an account. Otherwise, all data will be removed within 90 days after the termination of the contract. For more information regarding our terms, see item 9.
8. Guarantee and liability
8.1
mindthedev does not guarantee that all services listed under item 3 will always be available and error-free. This applies, in particular, insofar as access to these services can involve disruptions that lie outside mindthedev’s control. mindthedev will troubleshoot and remove any disruptions to the services named in item 3 in regard to technical and operational matters without delay.
8.2
Liability applies as per the German law on product liability (Produkthaftungsgesetz).
9. Term of contract and contract termination
9.1
The term of contract begins with the registration. The contract runs for an undetermined period. It can be terminated by the customer or mindthedev on a monthly basis with 14 days’ notice. The right to terminate without notice under item 11 remains unaffected.

10. Privacy
mindthedev collects, processes and uses personal data of customers which is necessary for processing, invoicing and drafting of the contract with the customer. Treatment of personal data by mindthedev is regulated in the privacy policy, which forms an essential part these terms and conditions. 11. Amendments to the terms and conditions
Developermail can change or extend the terms and conditions at any time. Customers will be informed of any changes beforehand via an email to the address the customer used upon the registration. If changes occur that are to the disadvantage of the customer, they can terminate the relationship without notice. Customers will also be advised of this right in the notification of changes.
12. Final provisions
12.1
Should one or more provisions in these terms and Conditions of trade be invalid or should this be the case in the future, this has no effect on the validity of the remaining provisions.
12.2
All legal relations between the contract parties are subject to German law. UN commercial law is excluded.
12.3
If the customer is a commercial trader as defined in the HGB (German Commercial Code) or legal entity under public law or public special assets or acts as such, the place of jurisdiction for all claims in connection with the contractual relationship is the relevant court in Frankfurt am Main, Germany competent for dealing with the matter concerned.
